Business Mediation Network’s “Dispute Resolution Attorneys” initiative is a program for lawyers designed to offer ways for lawyers to use mediation to enhance their practices, to improve their mediation advocacy skills and to customize the dispute resolution process for individual clients. The Dispute Resolution Attorneys program also provides suggestions on how attorneys can incorporate mediation in risk management strategies for their firms.
This initiative follows the approach recommended by Abraham Lincoln who, in an 1850 manuscript entitled “Notes for a Law Lecture,” encouraged lawyers to “persuade your neighbors to compromise . . . As a peacemaker the lawyer has a superior opportunity of being a good man. There will still be business enough.”
With skyrocketing litigation costs, increasing disclosure requirements, burdensome electronic discovery and declining civil trials, most businesses would rather find non-litigation alternatives to resolving conflict. BMN’s Dispute Resolution Attorneys initiative encourages lawyers to assist their clients and enhance their practices by using mediation to resolve business related claims. Please see “Educate, Explore and Engage – Pointers for Lawyers Preparing Clients for Facilitative Mediation,” an article by BMN Mediator Richard Glaser.
